Acceptable Use Policy

1. Purpose
This Acceptable Use Policy ("AUP") sets out the rules governing use of TalkTelX's managed VoIP services — including SIP trunking, DID numbers, inbound routing, outbound calling, and related infrastructure ("Services"). It applies to all customers, users, and anyone accessing the Services.
This AUP is incorporated into TalkTelX's Terms of Service. By using the Services, you agree to comply with this policy.
2. Permitted Uses
The Services are intended for lawful, legitimate voice communications, including:
- Inbound and outbound business calling with proper caller ID and consent management
- Contact centre operations with compliant dialling practices
- Internal business communications via SIP trunking or cloud PBX
- Customer service, appointment reminders, and transactional calling where appropriate consent has been obtained
- Any other lawful voice communication that complies with applicable regulations
3. Prohibited Uses
The following uses of TalkTelX services are strictly prohibited:
Regulatory violations
- Placing calls to numbers on the National Do Not Call Registry without a valid exemption or prior express written consent
- Using autodialling equipment or pre-recorded voice messages without TCPA-compliant consent
- Conducting telemarketing campaigns that violate the FTC's Telemarketing Sales Rule
- Violating any applicable state telemarketing, robocall, or consumer protection law
- Calling in violation of foreign telecommunications laws where calls terminate internationally
Caller ID and fraud
- Spoofing caller ID to misrepresent the origin of calls or deceive call recipients (prohibited under the Truth in Caller ID Act)
- Using our Services to commit fraud, scams, phishing, or impersonation
- Transmitting calls that falsely claim to be from government agencies, financial institutions, or emergency services
Spam and unsolicited communications
- Placing unsolicited commercial calls or robocalls without legally required consent
- Transmitting bulk, automated, or scripted calls designed to harass, mislead, or deceive recipients
- Any calling patterns that cause numbers to be flagged as "Spam Likely" by carriers through abusive practices
Network abuse
- Attempting to overload, disrupt, or degrade TalkTelX's network or the networks of other carriers
- Generating excessive concurrent calls beyond contracted capacity without prior agreement
- Exploiting the Services to conduct SIP-based denial-of-service attacks
- Attempting to access accounts, systems, or data you are not authorised to access
Resale and sublicensing
- Reselling, sublicensing, or white-labelling TalkTelX services to third parties without prior written authorisation
- Providing access to the Services to parties who would themselves be in violation of this AUP
Other prohibited activities
- Using the Services to facilitate illegal activities of any kind
- Transmitting content that is defamatory, threatening, harassing, or promotes violence or discrimination
- Any use that exposes TalkTelX to liability, regulatory sanction, or reputational harm
4. Compliance Responsibilities
Customers are solely responsible for ensuring their use of the Services complies with all applicable laws. TalkTelX provides tools to support compliance — including DNC list checking, STIR/SHAKEN attestation, opt-out processing, and audit logs — but these tools do not substitute for your own compliance programme.
You are responsible for:
- Maintaining valid consent records for all contacts you call using automated or pre-recorded means
- Honouring all opt-out requests promptly and propagating them across active campaigns
- Training agents on applicable regulations and your calling practices
- Keeping your calling lists clean and up-to-date with DNC suppression applied
- Monitoring your campaigns for call patterns that may trigger carrier flagging
5. Number Health and Caller ID
Customers using TalkTelX DIDs for outbound calling must maintain responsible calling practices to preserve number health and caller ID reputation. TalkTelX may:
- Monitor call patterns for signs of abuse or carrier flagging
- Notify you if your DIDs are at risk of being labelled as spam by carriers
- Rotate or replace DIDs affected by flagging as part of managed service
- Suspend DIDs that are generating significant carrier complaints
Deliberately inflating call volumes or cycling through large numbers of DIDs to evade carrier reputation systems is prohibited.
6. Enforcement
TalkTelX reserves the right to:
- Investigate suspected violations of this AUP
- Suspend or restrict access to Services pending investigation of a reported violation
- Terminate your account for material or repeated violations, in accordance with the Terms of Service
- Report violations to law enforcement, regulatory authorities, or affected carriers where required
Where possible, TalkTelX will notify you of a suspected violation and provide an opportunity to respond before taking action, unless the violation presents an immediate risk to the network or other customers.
7. Reporting Violations
If you become aware of misuse of TalkTelX services or suspect a violation of this AUP, please report it to us at [email protected]. We take all reports seriously and will investigate promptly.
8. Changes to This Policy
TalkTelX may update this AUP from time to time to reflect changes in applicable regulations, industry standards, or our services. We will notify active customers of material changes before they take effect. Continued use of the Services after the effective date constitutes acceptance.
